On March 18, the ministry of transport and the national development and reform commission (NDRC) issued a notice on the revision and issuance of the "measures on port charges and charges" (hereinafter referred to as the "notice") in order to further clarify and regulate the service charges of port operations and effectively enhance enterprises' sense of gaining from reducing burdens.The notice will be effective from April 1, 2019 and will be valid for five years.According to the notice, some government pricing standards will be lowered, fees will be consolidated and fees will be regulated.


Notice requirements, lower part of the government pricing standards

We will reduce the fees charged by 15 percent, 20 percent, 10 percent and 5 percent respectively for port charges, port facility security fees, pilotage (mooring shifting) fees and tugboat fees on domestic shipping routes.Domestic trade vessels (excluding chemical and liquefied gas vessels) of 80 meters or less in and out of coastal ports, and domestic trade vessels of 150 meters or less in and out of the ports of the trunk line of the Yangtze river, the ship's owner shall decide whether to use tugboats on the premise of ensuring safety and according to the actual situation.


Notice is clear, the combination of charges

In accordance with the principle of "deducting items and merging items", the name of the combination of storage and storage fee and the storage and storage fee shall be the storage and storage fee;The service charges for water supply (materials), oil supply (gas) and power supply shall be combined as the service charges for ship supply;The service fee for garbage reception and treatment and the service fee for sewage oil and water reception and treatment are combined as the service fee for pollutant reception and treatment of ships.


Notice points out, should standardize collect fees behavior

Port operators, pilotage agencies and other units shall strictly implement government pricing, implement the list of fees for port operation services and the public announcement system, and promptly adjust the names and standards of publicly announced fees in accordance with this circular.Relevant agencies collect and pay government fixed fees such as port charges and port facilities security fees on behalf of the enterprises.Fees shall not be raised or imposed in disguised form by any means.


At the same time, containment boom service units shall not provide containment boom service to vessels loading or unloading non-durable oils.Containment boom service units, tugboat operators, etc., shall not exceed the scope or standard of charges.The technical service fee for navigating the offshore mobile platform in China's waters other than pilotage service shall be subject to market regulation, and the specific service fee shall be determined by the piloting service unit through consultation with the entrusting party.

This notice shall be effective from April 1, 2019 and shall remain valid for five years.The ministry of transport and the national development and reform commission will timely improve relevant policies in light of policy implementation and market changes.The previous notice of the ministry of communications on matters relating to the collection of security fees for port facilities (jiaoshuifa [2006] no. 238) and the notice of the national development and reform commission of the ministry of transport on the issuance of "port fee charging method >" (jiaoshuifa [2017] no. 104) shall be repealed simultaneously.
